13th Floor Elevapors Addresses Letter From FDA

On May 10, 13th Floor Elevapors received a notice from the Food and Drug Administration (FDA) that one of their award-winning products contained advertising or labeling that may imitate food products.

“While we are disappointed that we have been targeted by the FDA for one of our many products, we look forward to working closely with the FDA to ensure that we meet all current and future regulations. Our number one priority is making sure that our loyal customer following will always be able to get their favorite e-liquid flavors from 13th Floor Elevapors,” said Sean Flaherty, a spokesman for the company. “For years we have heard success stories from our customers that have been able to make the transition from traditional tobacco products to our e-liquid products. These stories inspire us every single day.”

Although 13th Floor Elevapors’ labels and packaging have always contained a “21+” age warning, underage consumption has always been a concern for the company. “We strive to sell our products through our preferred outlets,” said Flaherty, “which maintain strict adherence to laws and regulations preventing the sale of our products to underage consumers. We plan on taking steps to ensure that this strict adherence is continued.”
