Accident Victim Wins Extra £10,000 After Low Compensation Settlement Through Solicitor's Negligence
Undersettlement of personal injury claims is an increasing problem as cases are handled under pressure by remote firms of solicitors.
Online, December 19, 2012 (Newswire.com) - A successful undersettlement claim is made by a local Personal Injury Solicitor after the initial compensation award was too low.
The value of personal injury claims in the UK has reached such a level (over £14 billion annually.) that many cases are now handled in a high-pressure environment and are settled too early and too low. In the rush to reach a settlement significant facts can be overlooked, leaving the solicitors handling the case open to a claim for damages for professional negligence.
One such case occurred recently in Faversham, and highlighted the danger of using a remote firm of solicitors rather than consulting a specialist, local Personal Injury Solicitor.
The client was the victim of a road traffic accident. He turned to a claims management company, which referred him to a firm of solicitors at the other end of the country. His claim was handled remotely with no face-to-face meeting. He only ever spoke to the solicitor over the telephone, and he was persuaded to accept a low compensation offer. He didn't really want to do this, but took the solicitor's advice - even though the situation was never properly explained to him.
He was then referred to Dominic Goward & Co - a local specialist Personal Injury Solicitor and a member of the Law Society's Personal Injury Panel.
"We were able to bring new medical evidence to bear on the case - evidence that the original solicitors had clearly overlooked", explained Mr Goward. "Our client's case had clearly been under settled, and we were able to secure an additional £10,000 for him.
"Anybody who feels that his or her case may have been under settled should seek the advice of a fully accredited, local Personal Injury Solicitor."
