Easley, MS, JD, BCS Appeals, along with Judge Bronwyn Catherine Miller of the Florida 11th Judicial Circuit Court, spoke in Miami on April 28, 2017, at the American Bar Association Appellate Practice Regional Appellate Seminar. Ms. Easley discussed “Frye versus Daubert, Where Are We, and the Appellate Implications.” Both Frye and Daubert are short terms for the legal standards by which expert testimony is admitted at trial when discussing a range of topics, from medical malpractice to patents, and they affect jury trials in both criminal and civil courts.
Ms. Easley explained to the attorneys and judges attending the seminar that, in 2013, the Florida Legislature amended the State’s Evidence Code, section 90.702, Fla. Stat., to abolish Frye and adopt Daubert as the standard to be used in Florida courts. “[T]he courts, including the Florida Supreme Court, have made clear that the overarching reason for section 90.702 is for scientific validity and the objective is to determine the relevance and reliability of the principles that underlie an expert's proposed evidentiary submission.” Ms. Easley concluded that the exclusion of expert testimony is still the exception, not the rule, whether it is Frye or Daubert, and that the focus of the inquiry under section 90.702 remains reliability of the principles and methodologies employed, not the conclusions that they generate. “Daubert's intended purposes are to exclude junk science that masquerades as scientific knowledge and to exclude novel principles, and those are also consistent with Frye.”
