On the heels of a february 25th $3.35 million transvaginal mesh verdict in new jersey superior court, Case Funding Inc., a specialty finance lender, assess what the verdict means for the lawyers handling more than 1,800 other cases pending in the United States.

NEW YORK, New York (February 27, 2013) - On the heels of a February 25th $3.35 million transvaginal mesh verdict in New Jersey Superior Court, Case Funding Inc, nationally recognized specialty finance lender that provides financing to law firms, assesses what the verdict means for the transvaginal mesh lawyers handling the other 1,800 cases pending in the United States.

According to a FoxNews.com article, Linda Gross, 47 and a nurse from South Dakota, alleged that the Gyncare Prolift vaginal mesh was not safe and that Johnson & Johnson and Ethicon were liable, among other things, for their defective design, manufacture, warnings and instructions.

The jury found that Ethicon failed to properly warn Gross's surgeon of the risks associated with the vaginal mesh and had improperly marketed the device, according to Reuters.

Richard Silverstein, president of Case Funding Inc., said the New Jersey trial is a good sign for mesh lawsuits filed throughout the United States and for those in the federal multidistrict litigations.

"The outcome of the first trial provides us with some insight into how future trials could potentially play out," said Silverstein. "This is good news for both the women who were implanted with vaginal mesh who believe they have suffered the often debilitating side effects of the mesh and for the lawyers handling these cases."

In addition to the $3.35 million in compensatory damages, the judge ruled that she would allow arguments on punitive damages, which are scheduled for the beginning of March, according to the FoxNews.com article.

"These products liability lawsuits serve both as a means for the victims to get the compensation they deserve and are big cases for the attorneys handling them," stated Silverstein. "But such big cases against deep pocket defendants also mean that the attorneys need access to financial resources to successfully litigate the cases."

Attorneys handling viable lawsuits have the option of obtaining litigation funding from specialty finance lenders for litigation support expenses, costs, operational expenses and marketing and business development.

"The more access an attorney has to working capital, the more success they will having litigating these types of cases against big name defendants, such as Johnson & Johnson," said Silverstein.
