Dallas Attorney Ramez Shamieh Successfully Defends Employee In Defamation - Breach Of Contract Case

Healthcare Consultants, Inc. (SHC). SHC alleged that Hoschar contacted the company's clients after she left the company in violation of her employment agreement and that she also damaged the company's reputation by making false statements to local media outlets. SHC sought damages in excess of $100,000.00 and attorney's fees. Hoschar filed a counterclaim alleging that SHC owed her commissions and sought her attorney's fees.
After a bench trial in Dallas County - 116th Judicial District Court, Judge Tonya Parker dismissed SHC's defamation claim on grounds that the company did not have standing under Texas law. Judge Parker also held that SHC committed a prior material breach of its employment contract with Hoschar by failing to pay her commissions and awarded Hoschar $14,612.35.
