Direct Auto Plaza Sued for Alleged Fraud and Violation of California's Lemon Law and Auto Financing Statutes

Online, October 6, 2013 (Newswire.com) - The Vachon Law Firm, a prolific San Diego, California based consumer law firm, has announced the filing of a lawsuit against the car dealership Direct Auto Plaza of El Centro, California. The lawsuit was filed in California's Imperial County Superior Court and alleges that Direct Auto Plaza violated numerous California consumer protection statutes. The lawsuit was filed in September 2013, and is titled Torres v. Direct Auto Plaza (Case Number ECU07861).

THE LAWSUIT'S ALLEGATIONS

The lawsuit's Complaint alleges that the consumer Plaintiffs visited Direct Auto Plaza in 2011, where they purchased a used 2010 Dodge Charger. The Plaintiffs allege in their lawsuit that prior to purchasing the Dodge Charger Direct Auto Plaza's representatives told them that the vehicle had been inspected and was in excellent condition. However, according to the Complaint, the Plaintiffs later learned that it had been involved in a serious accident in which it sustained frame damage.

In addition to these claims, the Plaintiffs also allege that when they purchased the Dodge Charger they were unable to make an immediate down payment large enough for Direct Auto Plaza to find a lender to finance the sale. They further allege that Direct Auto Plaza falsified the down payment and deferred down payment amounts in their purchase contract so that the dealer could obtain their signatures on the contract before they changed their minds and to trick a lender into approving an auto loan that it otherwise would have rejected.
