Federal Judge Rules Against Mother's Hague Petition to Remove Son From US Father to Mexico
Chicago, IL , March 13, 2016 (Newswire.com) - Thanks to the Law Offices of Jeffery M. Leving, Ltd., a nine-year-old boy will continue to live with his father in the United States despite underhanded attempts by his mother to take him out of the country permanently to Mexico. After this boy had lived most of his life in the state of Illinois, the child’s mother deviously removed him from his father’s care in Illinois and took him to Mexico under the false pretense of a 2-3 week vacation. Unbeknownst to his father at the time, the mother had no plans of ever returning the son to his father in Illinois.
Despite the mom’s many attempts to keep them apart, the child’s father, who is the boy’s custodial father, finally got his son’s mother to agree to allow him to come home for the summer. When the father refused to return the minor child to the mother in Mexico after her previous wrongful retention of the boy in Mexico, the mother filed a Hague petition to get the court to send the young boy back to Mexico.
The father knew he had a fight on his hands – one he could not win on his own. However, Andrey Filipowicz and James C. Nieland of the Law Offices of Jeffery M. Leving, Ltd. did the fighting for the father and won. Today, a federal judge ruled against the petition for the return of the minor child to his mother in Mexico under the Hague Convention. This little boy is now free to continue to enjoy the wonderful life he once knew in Illinois.
