Recognized Legal Nurse Consultant Discusses Long Term Care and New CMS Regulations

Nashville-based legal nurse consultant Alicia Davis, RN, LNCC, will speak at the first session of the inaugural Long Term Care Insurance ExecuSummit on June 27 at Mohegan Sun Hotel & Convention Center in Uncasville, Connecticut. She will join Drew Graham, Partner, Hall Booth Smith, P.C., and Steven D. Weiner, Partner, Kaufman Borgeest & Ryan LLP for “Help is on the Way: The New CMS Regs and Pros and Cons for the Defense of LTC Cases.”

Davis and the two attorneys will examine the recent Final Rule revisions set out by the Centers for Medicare and Medicaid Services (CMS) concerning nursing facilities. They will discuss how defense teams can leverage these new participation requirements in long-term care cases and explore some of their pitfalls. She will be available for meetings during the conference.

This topic is particularly timely given its profound impact on the legal, healthcare and insurance industries. The 184-page Final Rule is the first comprehensive revision to skilled nursing and long-term care regulations since 1991. Its requirements first began to go into effect in 2016, with the next new phase rolling out this November and the final changes to be implemented in 2019. With much detail left to subregulatory interpretive guidance, its ramifications may be numerous and complex.

She is past president of the Tennessee Chapter of the American Association of Legal Nurse Consultants.
