"The aspect of the trial practice has been greatly impacted by compulsory arbitration, contractually negotiated arbitration, and mediation. Iowa does not have compulsory mediation, so it's all done privately. I would suggest to you that better than 95% of the cases that are filed are disposed of by mediation. Another percentage would be disposed of by motion practice and probably 2% actually make it to trial. It wasn't that way when I started. We tried lawsuits all the time. But now it's tremendously expensive to try lawsuits."
Roland Dale Peddicord, Founder & Partner, Peddicord, Wharton, Spencer, Hook, Barron & Wegman L.L.P.
With over 50 years dedicated to law, Mr. Peddicord brings a wealth of knowledge to his industry and in particular to his area of specialization, litigation involving aviation, motor vehicles, product liability, and medical negligence. When asked why he decided to pursue a career in law, Mr. Peddicord said:
"I wanted to be a lawyer since I was eleven, but I originally thought I wanted to be a police officer. After I saw a movie about the FBI, I told my mom that I wanted to be an FBI agent and she told me that I couldn't be an FBI agent unless I went to law school. And at that time, I was shoveling the snow of a neighbor who was a lawyer and he told me how there was plenty of room for lawyers in this world, but that I would need a bit of education to get there. He later became a good professional friend."
As a thought-leader in his field, Mr. Peddicord understands the value of being able to wear multiple hats as an attorney. In addition to his skills in the courtroom, he is an expert in adjudicating matters under the American Arbitration Association’s governing rules, the Iowa Rules of Civil Procedure, and the Federal Rules of Civil Procedure. He has also meditated over one thousand cases with a ninety-five percent success rate and has served on arbitration panels in over two-hundred and fifty cases on behalf of the AAA. Mr. Peddicord said of the importance of arbitration and mediation:
"The aspect of the trial practice has been greatly impacted by compulsory arbitration, contractually negotiated arbitration, and mediation. Iowa does not have compulsory mediation, so it's all done privately. I would suggest to you that better than 95% of the cases that are filed are disposed of by mediation. Another percentage would be disposed of by motion practice and probably 2% actually make it to trial. It wasn't that way when I started. We tried lawsuits all the time. But now it’s tremendously expensive to try lawsuits."
