You're getting into a great disparity between what a patient has to pay back in medical bills versus what the insurance company said that would be or what the physician or hospital was willing to accept as payment in full. The question for trial lawyers becomes what the measure of damages is under the collateral source rule and whether it's being properly applied right now. This issue could be the biggest thing to impact tort litigation since the adoption of comparative fault.

With over 10 years dedicated to law, Mr. Rose brings a wealth of knowledge to his industry, and in particular to his areas of specialization, personal injury and insurance defense litigation. When asked why he decided to pursue a career in law, Mr. Rose said: "In 2007, my father died from a heart attack at a very young age. That meant that I got thrust into handling the majority of the files and over the years, handling thousands of cases that my father would have otherwise done, which exposed me to a lot of new and different issues and scenarios. I had to learn very quickly."
In the years since his father's tragic death, Mr. Rose has gained experience litigating a full range of tort cases in both State and Federal Courts. Over the course of his career, he has successfully defended numerous large insurance companies and their insureds in a wide range of personal injury claims from motor vehicle accidents to product liability and everything in between. Mr. Rose holds a reputation as a true thought-leader in his area of law. As such, in 2011 he was honored as one of only six attorneys in East Tennessee to be selected by United States Judge Ronnie Greer to oversee the recommendation of the re-appointment of United States Magistrate Judge Dennis Inman.
As a thought-leader in his industry, Mr. Rose keeps his eye on prevailing trends within personal injury defense. In particular, he is paying close attention to the question of phantom bandages in Tennessee. He noted, "You’re getting into a great disparity between what a patient has to pay back in medical bills versus what the insurance company said that would be or what the physician or hospital was willing to accept as payment in full. The question for trial lawyers becomes what the measure of damages is under the collateral source rule and whether it’s being properly applied right now. This issue could be the biggest thing to impact tort litigation since the adoption of comparative fault."
Outside of his time in the office, Mr. Rose dedicates his time and attention to his family and his community. His children are becoming active in sports and the time spent watching them compete is priceless. He is actively involved in his community and has held several leadership roles in both civic and professional organizations, including incoming President of the Rotary Club of Kingsport. He is past President of the Board of Directors for First Presbyterian Child Center. He is a Past President of the Tri-Cities Affiliate of Susan G. Komen for the Cure and has served as President of Court Appointed Special Advocates (CASA) for Children, a nonprofit dedicated to providing volunteer advocates to abused or neglected children.
