Gregory, Jr. of Keefe Bartels represented the Estate of Antonio Teixeira concerning a single tractor-trailer accident case in New Jersey Superior Court - Middlesex County, where Mr. Teixeira suffered catastrophic closed head injuries as a result. In the early morning of September 4, 2008, the tractor-trailer operated by Mr. Teixeira proceeded into a curve along Route 17 in the Village of Hancock, New York. At that time and place, the tractor-trailer loaded with construction debris lost control and flipped onto its driver side, skidding along its side down the highway. Mr. Teixeira was severely injured as a result of the accident.
After investigation by the Commercial Vehicle Inspection Unit, the New York State Police issued numerous citations concerning maintenance issues related to the truck's brakes, tires and axles. The tractor-trailer in question was under the exclusive use, possession and control of defendant DJM Transport by way of contract. Plaintiff's liability expert, James Eastmond, opined that these maintenance failures, and DJM's failures to address the maintenance problems, proximately caused the subject accident. The parties submitted to mediation before the Honorable Jack L. Lintner, P.J.A.D. (Ret.) on March 27, 2013, where the case settled for $650,000.
