Washington, D.C., Maryland, and Virginia Nursing Home Abuse Attorney Wins $1.28 Million Verdict for Severely Injured Client's Family

The Cochran Firm DC attorney secures trial victory for nursing home abuse and neglect victim's family in Spotsylvania County, Virginia Circuit Court

The Cochran Firm, DC today announces the important trial victory secured by nursing home abuse and neglect attorney W. Charles Meltmar in a negligence case filed against a Fredericksburg, Virginia-based elder care provider. Meltmar won a $1.28 million verdict, plus interest, for the family of a deceased client who suffered severe burns while under the care of a nursing home facility.

The victim suffered from paralysis, severe back problems, and other medical issues that left him with limited mobility. In addition, he was diagnosed with depression and psychosis. In May 2011, the victim was taken outside at 5 a.m. and left alone and unattended to smoke a cigarette outside the defendant's nursing care facility, Carriage Hill Health & Rehab Center. Because he was improperly left unsupervised while smoking, he was unable to free himself from a fire caused by smoking. The nursing staff found the victim on the ground with his clothes on fire and his body severely burned. As a result of improper supervision and negligence, the victim suffered horrible burn injuries.

Because of his injuries suffered while under the nursing home's care, the victim incurred enormous medical bills, pain and suffering, and disfiguring injuries. He retained The Cochran Firm DC to represent him in order to recover the cost of these damages. In order to secure justice for the victim who was needlessly injured, nursing home abuse and neglect attorney Meltmar filed a lawsuit in Spotsylvania County, Virginia, on his behalf alleging that the nursing home was negligent in its care and treatment of the victim.

By skillfully employing multiple expert witnesses, analyzing medical records, taking in-depth depositions, and vigorously opposing the nursing home's adamant denials of culpability in its court filings, Meltmar effectively presented the client's tragic story of a nursing home's corporate owners that put profits before people.

Based upon the evidence, the jury found the nursing home company was negligent and liable for the victim's injuries.

"This trial sends a message to the community that negligent and careless conduct by nursing homes will not be tolerated," Meltmar, nursing home abuse and neglect attorney with The Cochran Firm DC, said. "We hope this verdict will be a catalyst for positive change in the operational behavior of nursing home and elder care facilities throughout Virginia and the Washington, D.C. region."

The jury returned a verdict in the amount of $1.28 million, plus interest, to the plaintiff.
