Yadegar, Minoofar & Soleymani LLP Discusses New California Employment Laws for 2021

Together, they have discussed three new California employment laws that affect employees that went into effect on January 1, in 2021.

SB 1383: Expansion of California Family Rights Act (CFRA)

SB 1383 is a leave law that expands the California Family Rights Act (CFRA). It expands it in two ways:

  • It expands the law to most California employers.
  • It expands the list of reasons that employees may take leave.

Under SB 1383, the CFRA applies to any California employer with five or more employees. Employers must allow eligible employees up to 12 workweeks of unpaid, protected leave, during any 12-month period for the following reasons:

  • To bond with his or her new child
  • To care for his or herself, a child, grandparent, grandchild, sibling, spouse or domestic partner

An employee must have at least 1,250 service hours with the employer during the previous 12-month period to be eligible for leave under the CFRA.

AB 2017: Amendment to Kin Care Sick Leave

Assembly Bill 2017 amends Section 233 of the California Labor Code about kin care sick leave. It modifies Section 233 by stating that the designation of sick leave is up to the sole discretion of the employee. An employee may take kin care sick leave for any of the following reasons:

  • Diagnosis, care or treatment of the employee's existing health condition
  • Preventative care of the employee
  • Preventative care of the employee's family member
  • Employee is a victim of domestic violence, sexual assault and/or stalking

AB 2992: Protections for Victims of Crime or Abuse

AB 2992 expands Section 230 of the California Labor Code to also provide protections to employees who have been the victims of crime or abuse. It prohibits employers from discharging, discriminating or retaliating against employees for taking time off work for any of the following reasons:

  • To seek medical attention for injuries caused by the crime or abuse
  • To get psychological counseling or mental health services 
  • To get other services from prescribed entities
  • To get relief or attempt to get relief, as prescribed
  • To participate in safety planning
  • To take other actions to increase the employee's safety from future crime or abuse
